USMCA

On January 29, 2020, the President enacted the legislation approving the United States - Mexico – Canada Agreement (USMCA). The USMCA will create a more balanced, reciprocal trade relationship with Canada and Mexico, creating new opportunities for farmers, manufacturers, workers, and businesses and supporting high-paying jobs for Americans. Once it enters into force, the USMCA will replace the North American Free Trade Agreement and provide high-standard disciplines in a wide array of areas, including labor and environment.

The USMCA Implementation Act (Public Law 116-113) establishes an Interagency Labor Committee for Monitoring and Enforcement of the USMCA’s labor provisions (sec. 711 of the Act). The Committee’s responsibilities include, among other things, assessments of Mexico’s compliance with its obligations under Annex 23-A of the USMCA and recommendations for enforcement actions. See sections 712 through 719 of the Act for the Committee’s other responsibilities.

USTR is seeking attorneys to help monitor and enforce the obligations of the USMCA, particularly with respect to the labor chapter. Major Duties
• Serves as an attorney in the Office of the U.S. Trade Representative (USTR).
• Represents the United States in arbitral panels in international fora, in particular panels formed under the USMCA.
• Provides expert legal analysis and advice on trade and labor issues, in particular with respect to the USMCA labor chapter and Mexico’s compliance with its obligations under the labor chapter of the USMCA, working closely with USTR’s Office of Labor Affairs and labor attaches in Mexico.
• Develops and coordinates USTR’s legal position on potential disputes with USMCA parties related to labor issues.
• Develops and coordinates USTR’s legal positions for any disputes under the Facility-Specific, Rapid Response Mechanism provided for in Annex 31-A of the USMCA.
• Briefs USTR’s congressional committees of jurisdiction and other Members and committees of Congress on USTR’s legal work.
• Works closely with an Assistant U.S. Trade Representative (AUSTR) in formulating U.S. trade monitoring and enforcement policies and priorities, specifically related to trade and labor. Conducts research of laws, legal opinions, policies, or regulations on specific trade areas or broad trade and labor issues.

Specialized Experience
• Knowledge of general U.S. law. Knowledge of U.S. international trade laws and policies, Executive Orders, court decisions, and regulations affecting the work of the USTR desirable.
• Expertise and experience in labor law and practice, including with the application of international labor standards and rights as recognized by the International Labor Organization.
• Knowledge of the labor legal framework of Canada or Mexico desirable.
• Knowledge of the various sources of legal reference material concerning U.S. trade agreements, regulations, decisions, and policies.
• Knowledge of legal research methods.
• Ability to identify and analyze pertinent legal information.
• Litigation and advocacy writing experience.
• Ability to communicate in a concise, effective, and confident manner, particularly before high-level government officials and foreign government officials.
• Ability to work effectively in teams.
• Spanish language capabilities desirable.

Major Duties

• Conducts bilateral and multilateral negotiations concerning trade issues related to a variety of goods and services, committing the United States to the terms of the resulting agreements.
• Works closely with an Assistant U.S. Trade Representative (AUSTR) in formulating U.S. trade policies. Conducts research of laws, legal opinions, policies, or regulations on specific trade areas or broad trade issues. Recommends policy options to the appropriate AUSTR or other senior level official. Establishes policy options during trade negotiations to achieve satisfactory results. Develops and applies negotiating strategies and tactics. Based on knowledge of the trade issue at hand, prepares reports and other documents in anticipation of potential problems and issues.
• Provides expert advice and guidance to USTR officials on legal issues with respect to assigned trade issues. Develops and coordinates USTR’s legal position on all issues related to area of responsibility.
• Reviews current and pending legislation related to assigned areas and potential effect and impact on U.S. trade and the economy.

Requirements
• Knowledge of general U.S. law. In addition, knowledge of U.S. international trade laws and policies, Executive Orders and other statutes, court decisions and regulations affecting the work of the USTR, including laws dealing with import relief, unfair trade practices in import trade, tariff agreements and others.

Duties

The primary purpose of this position is to provide expert quantitative, industry and subsidies research and analytical support to the Center, its Director and senior staff related to trade implementation, enforcement, and monitoring.

As a Trade Enforcement Analyst (Quantitative), GS-0301-13/14, your typical work assignments may include the following:
• Research and analyze foreign countries' trade-related legislation, regulations and policies and economic and trade data.
• Using a variety of software, gather and arrange evidence and other materials for dispute settlement proceedings and enforcement negotiations.
• Develop and lead research plans and identify appropriate information resources to complete assigned projects. Take initiative to implement the plan, including within the interagency.

Qualifications

MINIMUM QUALIFICATION REQUIREMENTS: All applicants must meet the qualification requirements outlined below to be considered minimally qualified for this position. The qualification requirements are in accordance with the OPM Qualification Standards. All qualifications must be met by the closing date of this announcement.

TIME-IN-GRADE REQUIREMENTS: Applicants must have a minimum of one full year of specialized experience at the next lower grade level in Federal Service or equivalent pay band or equivalent experience in the private or public sector.

SPECIALIZED EXPERIENCE: Applicants must have a minimum of one year of specialized experience at a level of difficulty and responsibility comparable to the next lower grade or comparable pay band in the Federal service or equivalent experience in the private or public sector.

FOR THE GS-13 LEVEL:

Specialized Experience: Applicants must have at least one or more full-time years (12-months) of specialized work experience, equivalent to at least the GS-12 grade level in the Federal service, performing the following duties:
• Researching trade, economic or financial information using a variety of sources;
• Utilizing word processing, databases, and other software such as Microsoft Excel and Microsoft Access to gather and extract data; and
• Summarizing trade, economic, or financial data into written reports.

FOR THE GS-14 LEVEL:

• Extracting and summarizing data from financial reports, industry analyses, and other sources for trade purposes;
• Utilizing tariff schedules to collect and analyze pertinent trade data;
• Developing and leading research plans to initiate research, analysis, and interpretation of empirical trade and economic data and information; and
• Preparing reports and other materials containing data for use in negotiations and dispute settlement proceedings.

• This is a Drug Testing Designated Position (DTDP) and is covered by the Executive Office of the President Drug-Free Workplace Program. Qualifications

In order to qualify for the Trade Enforcement Analyst (Quantitative) position, you must meet the following minimum qualifications:

FOR THE GS-13 LEVEL:

Specialized Experience: Applicants must have at least one or more full-time years (12-months) of specialized work experience, equivalent to at least the GS-12 grade level in the Federal service, performing the following duties:
• Researching trade, economic or financial information using a variety of sources;
• Utilizing word processing, databases, and other software such as Microsoft Excel and Microsoft Access to gather and extract data; and
• Summarizing trade, economic, or financial data into written reports.

FOR THE GS-14 LEVEL:

Specialized Experience: Applicants must have at least one or more full-time years (12-months) of specialized work experience, equivalent to at least the GS-13 grade level in the Federal service, performing the following duties:

• Utilizing tariff schedules to collect and analyze pertinent trade data;
• Developing and leading research plans to initiate research, analysis, and interpretation of empirical trade and economic data and information; and
• Preparing reports and other materials containing data for use in negotiations and dispute settlement proceedings.
